Decision on Dong Zong chief’s objections on Nov 13

KUALA LUMPUR: The High Court will decide on Nov 13 whether Dong Zong’s former national chairman Dr Yap Sin Tian is allowed to maintain his contention that he is supported by the majority of the Chinese community.

This came about in a hearing yesterday after objections were raised by Lau Lee Ming, the new national chairman of the United Chinese School Committees’ Association of Malaysia (Dong Zong) and five state representatives.

The six are attempting to remove Dr Yap’s contention in his affidavit that he is supported by the majority of the Chinese community.

They have also applied for a court order to declare that the EGM called by them on Aug 23 to remove Dr Yap is legal.

The five state representatives who are joint plantiffs with Lau are: Ting Chuen Peng (Negri Sembilan), Pau Chiong Ung (Sarawak), Lim Tang Seong (Penang), Ding Chong Chow (Perak) and Chong Siang Jian (Pahang).

In the injunction application, Lau and the five named Dr Yap as the sole defendant.

The six are seeking to stop Dr Yap or his agents from taking legal action that could affect the decision of Dong Zong’s Aug 23 EGM, which elected a new set of office bearers and resulted in Dr Yap being ousted.

To support their application, they said that voting members of Dong Zong had resolved the leadership crisis of the association after appointing Lau as chairman.

They said the crisis was resolved at the EGM with guidance from the Registrar of Societies to prevent the association from being deregistered.

They said they needed a restraining order to ensure that their efforts to save the association would not be futile, and that the United Exami­nation Certificate this month would not be affected.

They claimed that Dong Zong would be prejudiced seriously if their bid for a restraining order was denied.

They are seeking a court order to stop Dr Yap from filing legal proceedings against the resolutions approved in the EGM.

Now, they want a declaration that the resolutions passed on Aug 23 and the decision of the EGM on their membership to settle the Dong Zong leadership crisis is valid.
